User Policy

This user agreement is a contract between you and eSwift, Inc. governing your use of your eSwift account and the eSwift services. If you are an individual, you must be at least 18 years old to open a eSwift wallet account and use the eSwift services. If you are a business, the business must be organized, operating to open an eSwift account and use the eSwift services.

By opening and using an eSwift account, you agree to comply with all of the terms and conditions of this user agreement, including the Fees, and any upcoming changes described on the Policy updates, page at the time you accept this user agreement (which changes will apply to you on the indicated effective dates). These terms include an agreement to resolve disputes by arbitration on an individual basis.

Acceptable use policy

You are independently responsible for complying with all applicable laws in all of your actions related to your use of eSwift services, regardless of the purpose of the use. In addition, you must adhere to the terms of this Acceptable Use Policy. Violation of this Acceptable Use Policy constitutes a violation of the eSwift User Agreement.

Please read carefully all of the terms and conditions of this user agreement, and each of the other terms and agreements that apply to you.

Prohibited Activities:

You may not use the eSwift service for activities that:

  1. violate any law, statute, ordinance or regulation.

  2. relate to transactions involving (a) narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, (b) drug paraphernalia, (c) cigarettes, (d) items that encourage, promote, facilitate or instruct others to engage in illegal activity, (e) stolen goods including digital and virtual goods, (f) the promotion of hate, violence, racial or other forms of intolerance that is discriminatory or the financial exploitation of a crime, (g) items that are considered obscene, (h) items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction, (i) certain sexually oriented materials or services, (j) ammunition, firearms, or certain firearm parts or accessories, or (k) certain weapons or knives regulated under applicable law.

  3. relate to transactions that (a) show the personal information of third parties in violation of applicable law, (b) support pyramid or ponzi schemes, matrix programs, other "get rich quick" schemes or certain multi-level marketing programs, (c) are associated with purchases of annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card, (d) are for the sale of certain items before the seller has control or possession of the item, (e) are by payment processors to collect payments on behalf of merchants, (f) are associated with the sale of traveler's checks or money orders, (g)involve currency exchanges or check cashing businesses, (h) involve certain credit repair, debt settlement services, credit transactions or insurance activities, or (i) involve offering or receiving payments for the purpose of bribery or corruption.

  4. involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent.

  5. relate to transactions involving any activity that requires pre-approval without having obtained said approval.

  1. Account Registration:

    1.1. Eligibility: To use the Service, you must be at least 18 years old and capable of entering into a legally binding agreement.

    1.2. Account Information: You must provide accurate and complete information during the registration process. You are responsible for keeping your account information up to date.

  2. Service Usage:

    2.1. E-Wallet Funding: You may add funds to your e-wallet through approved payment methods as outlined by the Company.

    2.2. Authorized Use: You are solely responsible for any activity conducted through your e-wallet account. You must not share your account details or allow unauthorized access. 2.3. Prohibited Activities: You agree not to use the Service for any illegal, fraudulent, or unauthorized purposes. Prohibited activities include money laundering, terrorist financing, or any actions violating applicable laws or regulations.

    2.4. Security: You are responsible for maintaining the security of your account credentials and any associated devices. You should promptly notify the Company in case of any suspected unauthorized activity.

  3. Transactions:

    3.1. Payment Authorization: By initiating a transaction, you authorize the Company to process the payment using the available funds in your e-wallet or the designated payment method.

    3.2. Transaction Fees: The Company may charge transaction fees or other applicable charges for certain types of transactions. These fees will be clearly disclosed to you prior to initiating the transaction.

    3.3. Refunds: Refunds, if applicable, will be processed in accordance with the Company's refund policy, which will be made available to you.

  4. Privacy and Data Security:

    4.1. Data Collection: The Company may collect and store personal and transactional information in accordance with its Privacy Policy. By using the Service, you consent to the collection, storage, and use of your information as outlined in the Privacy Policy.

    4.2. Data Security: The Company implements reasonable security measures to protect your personal and financial information. However, you acknowledge that no method of data transmission over the internet is entirely secure, and the Company cannot guarantee absolute data security.

  5. Intellectual Property:

    5.1. Ownership: All intellectual property rights related to the Service, including but not limited to trademarks, logos, and software, are the property of the Company or its licensors.

    5.2. Limited License: The Company grants you a limited, non-exclusive, non-transferable license to use the Service solely for its intended purposes and in accordance with this Policy.

  6. Termination:

    6.1. Termination by User: You may terminate your account at any time by following the instructions provided within the Service.

    6.2. Termination by Company: The Company reserves the right to terminate or suspend your account, with or without cause, at its sole discretion.

    6.3. Effect of Termination: Upon termination, you will no longer have access to your e-wallet account, and any remaining funds, if applicable, may be subject to the Company's policies regarding refunds or escheatment.

  7. Disclaimer of Warranties:

    The Service is provided on an "as is" and "as available" basis. The Company makes no warranties or representations, express or implied, regarding the Service's availability, functionality, or suitability for any particular purpose.

  8. Limitation of Liability:

    To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Service.

  9. Governing Law and Dispute Resolution:

    This Policy shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising under or in connection with this Policy shall be resolved through arbitration or other mutually agreed-upon dispute resolution mechanisms.

  10. Modifications to the Policy:
